Passenger Transport and Service Agreement

1-The parties Zaliha Kiraz will be named as "Kıbrıs Tatil Transfer".

2-By this Agreement, the parties; before and after the flight, are agreed to provide a transfer service from the defined addresses to the airports and the reverse direction, this service will be provided by Kıbrıs Tatil Transfer within the scope of the below agreement conditions.

3- Service and Payment Information

3.1. Agreement price included Value Added Tax …. İs TRY ................

3.2. In private transfer service, the directions to go are determined. If the customer wants to go via another different direction he must pay for each different point the sum of TRY  …..

3.3. The Company may change the type of vehicle with another upper type if necessary. In case the customer does not accept this change, he / she has the right to cancel his / her reservation and to refund the whole fee. In this case, the customer will not have the right to indemnity

3.4. I hereby authorize the company to collect payment for the services provided to me via the following credit card number.

3.5. . Invoice issuance time for purchased service according to Tax Procedure Law is 7 days including the purchase date under the condition to not omit the months. Method of payment: Bank: Amount in cash: Credit Card: Card

4-Transfer Type: One direction(Single/Double Direction)

5-Vehicle Type:  Type of vehicle chosen by the customer (Automobile / Minibus)

6-Number of persons: Number of person must be declared by the customer.

7-General Provisions: Passengers are required to wear seat belts as required by the Traffic Law. If the passenger has not signed the contract with virtual pos, mail order, money order or EFT and has not signed the contract for any reason, the terms of the contract will be valid between the parties, it will be consider that the customer has learned Agreement conditions on the website or with the advertisements and the customer agreed to receive subject service in the Agreement under the written conditions. The customer must make a reservation 6 (six) hours earlier than the transfer time to profit the transfer service subject of this agreement. At religious and national holidays, Christmas and other public holidays he/she must make a reservation 24 (twenty four) hours earlier that the transfer time. The reservation can be cancel from the customer 12 hours earlier before the transfer time. In this case the payment amount will be return to customer. In later reservation delays a refund will not be done. During the transfer, the route from the departure point until the arriving point will be decide individually by Kıbrıs Tatil Transfer; by taking into consideration traffic, road condition and other criteria. Customer has no right to change this route. Within this scope, the request of the customer to visit a different location or to wait there will not be accept. Kıbrıs Tatil Transfer is responsible only to transfer the customer from a point to the airport or from the airport to a point. Kıbrıs Tatil Transfer, for transfer service; it must provide a vehicle suitable to the number of passengers and baggage volume according to the conditions while the customer bought the service online. Kıbrıs Tatil Transfer accepts and engage that its vehicles will be equipped with individual insurance and passenger insurance, vehicle periodic maintenance will be done, there will be the compulsory materials as spare wheel, first aid material, fire extinguisher, reflector. Kıbrıs Tatil Transfer will not be responsible for a road accident or another accident during the transfer if the customer has injured physically or materially or his/her goods and/or objects are injured.  In this case the customer accepts and declare in advance and irrevocably that Kıbrıs Tatil Transfer has no responsibility arising from the article 66 of he law of obligations and the other articles of the regulations. The articles of this Agreement encumbering responsibilities to Kıbrıs Tatil Transfer are reserved. Despite the allotment of the suitable vehicle if it is transgressed the number of person and the baggage limit determined by the customer during the buying, the transfer will be realize without overpassing the legal transportation limit of the vehicle. Baggage or passenger overpassing the legal limits will not be accept to the vehicle. If the customer renounce to voyage because this reason the amount he/she paid will not be return. The customer must prove via his/her identity card or his/her voucher/reservation document delivered by the legal authorities to Kıbrıs Tatil Transfer staff from which he/she will have a service. It this condition is not accomplished the transfer will not be realize.  Kıbrıs Tatil Transfer responsible staff must follow the operational cancellation and/or delay the state in flight programs already reserved by the customer for transfer service and take all the necessary precautions in time without asking an additional fee for this.  Within this scope, in case of the cancellation of the flight for any reason, if the passenger already paid the transfer fee to Kıbrıs Tatil Transfer, the whole of subject amount will be return by Kıbrıs Tatil Transfer within 7 (seven) days to the bank account declared by the customer. Kıbrıs Tatil Transfer is not responsible for the loss or damage of the goods that are forgotten by the customer during the transfer. But if Kıbrıs Tatil Transfer staff remarks that there was a forgotten object in the vehicle and by the demand of the customer, it will be delivered to an address in Cyprus at the same day under condition that the customer will pay the expedition fees. during the transfer process Kıbrıs Tatil Transfer does not accept as baggage, crate, master carton etc. The passenger has a maximum of 15 kg baggage allowance per person. In case of loss or damage of baggage that the customer has not declared its value The service fee is paid to the passenger as material and moral compensation. The customer accepts, engages and declare that in his/her baggage, there is no an article flammable, sparkler, explosive, drugs, fluent, smelling, radioactive and prohibited by the regulation of North Cyprus. In the baggage if the presence of counted substances is noticed by the driver, such baggage is not accepted into the vehicle. During the evacuation of substances from the luggage, amount return will not be done if there is a overpassing of 15 (fifteen) minutes as mentioned below and for these reasons the transfer is not realized or the customer missed his/her plane. Besides, in these cases, the customer has no right to make a claim on against Kıbrıs Tatil Transfer. In the baggage; if the presence of the above-mentioned substances is remarked, Kıbrıs Tatil Transfer will warn immediately legal authorities. He presence of subject articles are not remarked by the driver but during in a police investigation; the damages arrived to Kıbrıs Tatil Transfer because of this will be cover by the customer fully paid in cash.  The customer's pet transfer requests and the type of pet to be transported will be notified by the customer during the online purchase of the service. Pet transfer is not done without subject notification. Without an adult single pet transfer is forbidden. The pet accepted under these conditions can be carry in the private place of Kıbrıs Tatil Transfer staff vehicle, under the obligation that all kinds of responsibility belong to customer, in a special cage. According to North Cyprus law, if there is a prohibition to transfer, to acquit or to be with a pet, the transfer will not be possible. In the transfers from a point to the airports; declares and undertakes that the vehicle allocated for Kıbrıs Tatil Transfer will be located at the point determined at the transfer time. 15 (fifteen) minutes delay is acceptable and reasonable beginning from the transfer time. The customer does not have to wait for the vehicle for the delays overpassing 15 (fifteen) minutes.  In this case transfer fee is returned to the customer. At transfer points such as site, mass housing; because of site security staff hindering the vehicle to enter to the site, Kıbrıs Tatil Transfer will not be responsible to overpass 15 (fifteen) minutes delay. If 15 (fifteen) minutes delay is overpassed and the customer did not wait as explained here, the return will not be done. The customer must be ready at the appointment point with his/her baggage at the fixed time. If the customer is not ready at the transfer point at the fixed time, the vehicle assigned by Kıbrıs Tatil Transfer must wait during 15 (fifteen) minutes. At the end of 15 (fifteen) minutes if the customer has not reached yet to the fixed point, the vehicle is not responsible to wait more. At the transfer point, Kıbrıs Tatil Transfer staff are not obliged to leave the vehicle and carry luggage, pet cage and to escort the customer to carry these items to the vehicle. The transfer of children under the age of twelve will not be performed without adult companions.  Back transfer of the companion to the departure point is depending on whether a back transfer service was bought or not in web site.  If a wheelchair transfer is also requested with the customer to be transferred, this will be notified by the customer during the online purchase of the service. If the customer states while buying the service online, a baby seat will be install in the vehicle by Kıbrıs Tatil Transfer. Kıbrıs Tatil Transfer is responsible only to return the service fee paid in cash if the customer is missing the plane for one of the following reasons, weather and road conditions, vehicle malfunction, sudden health problem related to the customer or driver, controls to be made by law enforcement officers during the transfer and other reasons.  The conditions of this agreement predicted the cases that a money return will not be done are reserved.  The customer accepts, engage and declare that Kıbrıs Tatil Transfer, except money return responsibility, has no other liability or material and moral loss indemnity or to pay airplane ticket price. If the customer renounce the transfer while the transfer, Kıbrıs Tatil Transfer has no responsibility to carry the customer to the departure point. If the work program does not allow the customer is left in the nearest residential area in accordance with the traffic rules. In such a case there is no money return. Kıbrıs Tatil Transfer has no responsibility in following cases: If the customer forgets an object during the transfer or request to return to the departure point and if he/she request to terminate the transfer despite these conditions. If the vehicle working program enable Kıbrıs Tatil Transfer has the option to realize this request of customer to the degree that it can do. In such a case, Kıbrıs Tatil Transfer is not responsible for the damages or if he/she miss the plane and any money return will be done. In the event of any health problems of passengers or animals transported in the vehicle during the transfer; Kıbrıs Tatil Transfer staff is responsible to carry the passengers to the nearest health unit immediately. Passenger's request on the contrary is not binding for Kıbrıs Tatil Transfer staff. The closest health unit may be a public health institution and also a private health institution. Kıbrıs Tatil Transfer is not responsible for the dead, damage to the body, any further damage to the financial and emotional damage cases during and after the transfer to the nearest health institution of the passenger/pet having a health problem. At the end of the transfer, the customer is obliged to sign the notification document that he/she reached the destination after bought the service. Upon Customer's Request, related service invoice, will be send by Kıbrıs Tatil Transfer to the address declared by the customer.

8-Force Majeure: These are the cases not caused by parties, natural events, negative climatic conditions, social events, public movements, events occurring due to negative developments in working life, all kinds of legal or illegal workers or employer movements, strikes, lockouts, trade union movements and work slow-down actions, war, armed conflict, revolution, martial law or state of emergency, inter-group conflict and riots. If the parties are not able to accomplish their responsibilities in this agreement because of a force majeure, subject agreement will be suspend until the force majeure case effects end. The agreement will enter into force again when the negative effects of the subject cases finish. The failure of the parties to fulfill their obligations as a result of force majeure does not give the other party an indemnity right or rescission.

9-Cancellation Policy and Other Provisions: In the promotional product bought by the customer, there is no a cancellation, change and money return. The requests made to the banks or to Kıbrıs Tatil Transfer for the annulment and return demands of the delayed reservation are invalid.

10-In case of a problem in this agreement, the legal authority to resolve these problems is the North Cyprus Courts and directorate of execution.

11-The passenger(s) not having a signature in the running contract but having the service will be consider as they accepted this agreement when the 3rd parties employed by them as their representatives have read and signed the subject agreement. This agreement has been prepared as 2 copies and signed by both parties. In case of a conflict arising the agreement, road transport code and North Cyprus regulation are applied. The Courts and Directorate of Execution of Famagusta are authorized.  I read, understood and accepted the whole agreement prepared on behalf of our name in which it was written departure date and time, the road transport code numbered 4925 and the information at the internet page and I received one copy.
